Sovereign Citizen Legal Paperwork


   I am not an advocate of granting unconditional sovereignty to everyone. I 
have a double standard. To me the opportunity to be sovereign is an astound-
ing and generous offer from the general American public which will remain
open if the nightmare of crass expression it makes possible doesn't get too
nasty for the majority to cope with. The way the law is presently engaged,
everyone, especially if they are young,is seduced with offers of license
(overt permission) to be a heedless participant in the public melodrama, in
exchange for permission to the government to suffocate them with rules.
Anyone who would want such permission I would rather was bound by rules. So
I intend the following for those without a grudge against the public
melodrama.
   It is also very important to note that there is currently no sovereign
local governments anywhere in America, that I know of. All of them have
accepted federal grant money that creates a binding federal contract making
the receiving entity subject to all federal rules. Only a citizen of the
federal corporate government can vote in an election directly or indirectly
affecting the federal corporation. The voter registration form overtly
declares this, with a promise of up to five years in jail and a $100,000
fine for violation.
   I am a Citizen of the local State of Oregon, the "underground economy",
which currently has no government; it is a true anarchy, ruled by direct
intimidation and friendly deception between more or less equals. Morality
remains relative and nearly always undeclared. For now I get along okay with
that though it may be a sleeping tiger.
   What I have done to become a sovereign citizen is cancel my government
designed paperwork and replaced it with my own. I sent a lot of letters
telling various people and offices what I was up to but no-one showed the
slightest interest. Nothing I did was illegal but some of my County
recordings were irregular. The County Clerk majorly tightened the acceptable-
ness criteria for submissions, perhaps because of me. They made quite an
effort to not accept the Declaration of Land Patent on the grounds that it
is nonsense consuming valuable public file space. I think they have a valid
point, though not about the Land Patent (they did record it). I believe that
sovereignty has to be legally declared to be legally binding but I think now
the proper place is the legal section of the local newspaper. I would have
run the ad on my birthday so I wouldn't forget the date. My local library
keeps every issue on microfilm forever.
   The first thing I did was buy a book from a guy named Johnny Liberty and
read it clear through. I recommend getting thoroughly familiar with this
subject if you plan to cancel your citizenship. Mr. Liberty's book has a
complete package of more affidavits than I had any use for and a pretty
exhaustive explanation of all the possible issues this raises. He has kept
a middle class lifestyle going as a sovereign citizen, definitely a bigger
challenge than my situation. He drives a legally unregistered truck with
some sort of very expensive international driver's license. He is in Eugene,

   His approach is pretty harsh on the subject. I edited out the nastier
words on the affidavits. I looked up all the legal references he makes also;
the University of Oregon law library was quite open to me and easy to use.
Quite a few of the references were a serious puzzle to relate to the
affidavit they were in and three I couldn't find. Here are some of the
puzzling ones:
   28 USC 1746(1) does not indisputably support the corporate use of the
             term "United States". You should definitely read that one.
   18 USC 31 defines "motor vehicle" as something in commercial use but
             specifically states that the definition is for that chapter
             only. The chapter is not about highway use.
   42 USC 411(b) does not make a reference to "nonresident alien" that I
             could find.
   42 USC 1.871-4 (and 42 USC 871-4), 26 USC 7701(a)14 and 26 USC 7701(b) I
             was unable to find.
   I took this as a warning that I am really on my own for legal advice. I
spoke with a couple of friends who are lawyers and they encouraged that
view. My view has become that Mr. Liberty's interpretation of the overall
intent of the rules is required by the constitution, which may still mean
that it is wishful thinking; but it means to me that his text is valid. I
did not delete any of his references in the affidavits. I think now that I
should have but that there is little harm in the matter. What I consider
important is the overt pledge of allegiance to myself that they express from
the six different angles of the six I used. The six are as follows:
   
   1-I revoke all direct or indirect delegation of a power of attorney
     (right to represent me in a legal proceeding) to anyone else,
     absolutely.
   
   2-I declare my allegiance and Citizenship to be to the geographic area
     called America and the geographic area called Oregon. I also explicitly
     declare that I am not a citizen or resident of any area explicitly
     owned by a private or government corporate entity. I am an American
     National and a Citizen of the Republic State of Oregon.
   
   3-I declare my identity, my domicile and a brief form of affidavit 2. I 
     include a color photo of myself.
   
   4-I affirm my conviction that the use of public right of way is a common 
     right to liberty protected by the fifth amendment.
   
   5-I voluntarily withdraw from the Social Security program.
   
   6-I declare that I am a "non-resident alien" of the corporate United
     States and the corporate State of Oregon, and have no sources of
     income within either of them.
      
   The first affidavit is to withdraw support for the representative govern-
ments going the extra step of representing me in legal proceedings with the
international bankers, the federal reserve, the United Nations or between
any of the several levels of government. This is to forbid any one making a
contract in my behalf.
   The Third one I made a color copy of to make a wallet size identity card.
   The fourth one declares driving to be a common right. I dislike driving
or even use of motors, but for most people this has been a big deal.
   Social Security is the basic corporate citizen contract explicitly
engaged as an adult and granting the license to beg the government. It has
to be just as explicitly revoked.
   The six one is a statement of my income tax status. The Supreme Court has
overtly rejected the legal concept of a non-corporate United States within
the corporate one, particularly as a tax matter. Only Indian nations get
recognized as outside of the corporate government by the I.R.S. so this may
be a very serious matter for some people. I am so horrified by the ecological
compromises of the economy that I play almost no part in it.
   As I understand the use of words the direct federal income tax is
deliberately prohibited by section 9, clause 4 of the Constitution:
   -No Capitation, or other direct, Tax shall be laid, unless in Proportion
    to the Census or Enumeration herein before directed to be taken.
   But from my reading, the framers of the constitution apparently didn't
anticipate an income tax because it would have been entirely unenforcable,
and to a huge degree it still is dependent on voluntary declaration of income
on the part of the person paying. The Supreme Court ruled in the late 19th
century that the clause above forbade only a federal property tax and a tax
on the rental income from property. The 16th Amendment was written to
redefine rental income as a taxable factor in the same class as wages.
   A federal tax based on personal wealth is thus forbidden but not a tax on
earnings. The fifth Amendment forbids a law threatening criminal (as opposed
to civil) prosecution for failing to file a personal account such as a tax
form 1040, so the I.R.S. has been forced to use a lot of seriously
bad-hearted intimidation and confusing rhetoric to compel people to self
assess and send in money. In recent years, indirect methods of tracking
peoples' income have gotten widespread so this may get more honorable and
understandable.
   I personally related to the income taxes and the local property tax
differently than most sovereign Citizens. Rather than viewing the matter as
polite highway robbery I take the tax activity and all regulation activity in
general as a warning of human relating that I will only regret being part of.
   I also made copies of another statement, written by Mr. Liberty, that he 
calls a Legal Notice. It summarizes all six affidavits, declares that the 
situation it addresses resulted from deliberate fraud by all levels of
American government, without which, I would not be in this position and
demands the purging of all my government records. I inserted the following
paragraphs:

   This legal notice is to no way imply my intent to act, or to arrange my 
life, in a manner that is in any way contrary to the actual offer of
opportunity from the people of my nation, the United States of America,
expressed in the United States Constitution and the Bill of Rights.If at any
later date any document with my signature is found through logical legal
assessment to suggest otherwise I here express my intent to amend or alter
that document in whatever manner necessary to remove that suggestion.
   I further declare my intent to abide by any changes in the U.S.
Constitution or the Bill of Rights, made by the American people through
lawful process. Limited by that, I do solemnly swear that I will support and
defend the U.S Constituion against all enemies, foreign and domestic, within
the bounds of my non-violent religious conviction.

   I then sent 14 letters, eight of them certified mail, each with the legal
notice and copies of one or two of the recorded affidavits. The letters went 
to:
   -President Clinton, with numbers 1 and 2, certified
   -Vice-President Al Gore, with numbers 1 and 2
   -Department of Health and Human Services, with number 5, certified
   -Social Security Administration, Ass.General Counsel, with number 5,
        certified
   -Social Security Administration, Commissioner, with number 5, certified
   -Social Security Administration, local office, with number 5 and my
        social security card, certified.
   -Secretary of the Treasury, with numbers 1 and 5, certified
   -Federal Secretary of State, with numbers 1 and 2, certified
   -Oregon Secretary of State, with numbers 1 and 2, certified
   -Immigration and Naturalization Service, number 1, certified
   -Congressman DeFazio, with numbers 1 and 2
   -Oregon Governor Kizhaber, with numbers 1 and 2
   -State Senator Sorenson, with number 2
   -City Manager Norris, with numbers 1 and 2
       
   I also returned my boat registration to the Oregon Marine Board and motor
vehicle paperwork, plates and license to the Oregon DMV. I also sent the DMV
a Notice of Vehicle to be Dismantled for each of my vehicles.
   Mr. Liberty also said in his book that I should demand an Oregon Republic
voter registration form from the Lane County Elections Department. They re-
fused and, not having a political agenda I would like to further, I didn't 
press the matter farther. I recently emailed Congressman DeFazio to ask his
office about it and he wrote that only U.S.Citizens can vote.
   The SSA wrote back saying that under some circumstances even a non-
resident alien is eligible for U.S. government money and that I cannot deny
the public or any other individual the right to consider me eligible for
their generosity, though I can refuse it. I did some reading in IRS
Publication 519 and found out even a non-american is assessed social
security tax on any work under an American contract. This is what I call an
excise tax on contracting which I think is allowed by the Constitution. Many
sovereigns blow this off and are given an IRS lien. Only a sovereign who
does their work self-employed without a contract with any of their customers
is exempt as I understand it from the Social Security Act, section 811.
   The Immigration and Naturalization Service Customer Chief wrote to say
that for an American National to renounce their United States citizenship
(small "c") they must also renounce their American Nationality. His view is
that I was born a U.S.citizen due to the 14th Amendment (from 1866). The
exact wording is:
   Amendment 14 -All persons born or naturalized in the United States, and
subject to the jurisdiction thereof, are citizens of the United States and
of the state wherein they reside. No state shall make or enforce any law
which shall abridge the privileges or immunities of citizens of the United
States;....etc.
   -------
   U.S.Constitution,Article II,clause 5: No person except a natural born
Citizen, or a Citizen of the United States, at the time of the Adoption of
this Constitution, shall be eligible to the Office of President;...etc.

   The Amendment states "and subject to the jurisdiction thereof" in order
to exclude embassy people and Indians, and uses a small "c" for citizen
unlike the Constitution. The Constitution uses "or" between the two kinds of
Citizen, clearly implying two kinds. The Amendment was written to prohibit
the citizenship limbo of black people in some of the States, reversing the
Dred Scott Supreme Court decision.
   A Supreme Court case in 1855 (Exparte Knowles 5 Ca.) carried the view
that being a Citizen of the United States could only follow from successful
acceptance as a Citizen of a State. Free black people were expected to form
their own Nation as the Indians had, and likewise Mormons and other self
determined wierdos.
   In several taxation cases after the 14th Amendment, the Supreme Court has
expressed the view that now anyone in America is subject to the jurisdiction
that they were born into, overtly denying the possibility, let alone the
right, of anyone to be a jurisdiction of one or part of a jurisdiction of
their own invention. Hense sovereign Citizens all reject the legitimacy of
this Amendment, generally using the term U.S. citizen to denote a citizen of
the United States who has contracted into or otherwise accepted being a
subject of the federal bureaucracy.
   I don't feel a need to compel other people to view me as I view myself.
I prefer to keep the warning of their disrespect and the warning that I may
be kidding myself about my self-determination. So I let immigration people
keep their view of me as a U.S. citizen without debate.
   The word "state" is also not capitalized. All the Amendments from number
11 to number 22 use the small "s". The Constitution, Declaration of
Independence and  Amendment numbers 23 to 26 and 2 to 10 use the large "S"
(1 and 27 don't include the word). There is no obvious constructive intent
for this that I can see. In the Declaration the "u" in united States of
America is small. In my view capitalization or not expresses the current
attitude but sets no legal precedent. Those who consider themselves above
the federal government use the small "u". Those who exalt the national
government use the small "s". Those who mention Citizen as a noble
designation use a large "C".
   So the Union Congress in the civil war had a bad attitude and declared
the national seat to be base in a seriously mean game of tag. I think it
fair to claim to be not on base, taking my chances with the local, and
somewhat more accountable, Republic. And I capitalize everything, as the
Constitution does.
   Representative Sorenson wrote back a handwritten letter in a friendly
tone but indicating he thought I was an immigrant becoming a U.S.Citizen(!).
   No-one else wrote back. The local letters I hand delivered. The SSA
counter person was surly but the others were friendly, neither due to me I
think.
   The Marine Board and DMV wrote back releasing my vehicles so I tracked
down the people I got each from and obtained a notarized Bill of Sale from
each, giving them each $6 worth of real silver to get around the federal
reserve note having no actual value. I then wrote a declaration, also from
Mr. Liberty's book, for each, saying as much and claiming allodial
(unconditional) possession. These also went into the county record and were
perhaps the last straw for those folks.
   After that I bought another book from Mr. Liberty, describing the Land
Patent concept and providing forms, and I completed a Land Patent.
   My main reason to do all this was to make peace with America within
myself and the paperwork has done that. Again and again I have got hurt
feelings over the surly anti-government remarks of friends. My view has
become more than ever that expressed by Thomas Jefferson as:
   "We owe every other sacrifice to ourselves, to our federal brethren, and
to the world at large to pursue with temper and perseverance the great
experiment which shall prove that man is capable of living in society
governing itself by laws self-imposed, and securing to its members the
enjoyment of life, liberty, property and peace; and further, to show that
even when the government of its choice shall manifest a tendency to
degeneracy, we are not at once to despair, but that the will and the
watchfulness of its sounder parts will reform its aberrations, recall it
to original and legitimate principles, and restrain it within the rightful
limits of self-government."
   For the sake of my sanity I need to find a hopeful dream for my part in 
the public melodrama.

                     Social Security section 811



SEC. 811. When used in this title- (a) The term wages means all
   remuneration for employment, including the cash value of all
   remuneration paid in any medium other than cash; except that such term
   shall not include that part of the remuneration which, after
   remuneration equal to $3,000 has been paid to an individual by an
   employer with respect to employment during any calendar year, is paid
   to such individual by such employer with respect to employment during
   such calendar year.
   (b) The term employment means any service, of whatever nature,
   performed within the United States by an employee for his employer,
   except-
 * (1) Agricultural labor;
 * (2) Domestic service in a private home;
 * (3) Casual labor not in the course of the employer's trade or
   business.
   (4) Service performed by an individual who has attained the age of
   sixty-five;
   (5) Service performed as an officer or member of the crew of a vessel
   documented under the laws of the United States or of any foreign
   country;
   (6) Service performed in the employ of the United States Government or
   of an instrumentality of the United States;
   (7) Service performed in the employ of a State, a political
   subdivision thereof, or an instrumentality of one or more States or
   political subdivisions;
   (8) Service performed in the employ of a corporation, community chest,
   fund, or foundation, organized and operated exclusively for religious,
   charitable, scientific, literary, or educational purposes, or for the
   prevention of cruelty to animals, no part of the net earnings of which
   inures to the benefit of any private shareholder or individual.
